The EPO is an independent international body having no links with the EU Community. The EPO was created by the 1973 European Patent Convention (EPC). To date 31 countries are EPC signatories. Whilst being primarily a patent granting office the EPO has missions to push for patent policy at European and even international levels. It has a business tradition of its own with very little knowhow for what happens in Brussels in a more global situation. Initiatives from Brussels implying huge changes to the pre-existing multilateral European patent scheme are considered as an insult attack on the holy writ.
DG MARKT’s relations with the EPO, especially on COMPAT, have been problematic in specifically under the former EPO President: the EPO has been highly sensitive to the infringement on their prerogatives by the Commission and we have been worried by EPO’s efforts to take on a policy role which does not belong to it. The situation has improved under the current President. The EPC has de facto fitted in the following issues: patentable subject matter, priority, effects of patents, criterion for the granting of patents, extent of protection of the patent. The EPC has not fitted in issues such as mandatory licensing, grace period, employees’ inventions, study research exceptions and contributory infringements.
