The three types of the Tort Negligence Assignment Help Tort Negligence
In legal situations, a tort is a civil wrong that creates an unjustified loss or harm to another person, culminating in legal responsibility for the person who committed the tortious act (Levmore, 2019). Though offenses can be torts, the civil case is not always based on a felony as the damage may result from negligence. The plaintiff of the harm will sue for compensation for their loss. To win in a case, the complainant (also known as the injured party) should establish that a violation of duty, either by action or inaction, was the lawfully identifiable cause of the injury.

The term ‘negligence’ refers to simple recklessness. In a legal sense, it refers to an inability to practice the level of care that a sensible individual would have practiced in similar situations. In general, a legal obligation to exercise caution exists when it was reasonably predictable that failing to do so would result in injury (Morgan, 2021). Negligence is a type of conduct in which several types of harm can be caused by failing to take such appropriate precautions. It could be classified into three types:
Misfeasance
This refers to failing to act reasonably when one should have performed it appropriately. For instance, repairing an old building but using very low-quality materials increases the likelihood of a collapse injuring individuals (Stoyanova, 2020).
Nonfeasance
This refers to a person’s inability to fulfill an action that they should have performed. For instance, failure to repair an old structure when it should have been repaired is classified as nonfeasance negligence (Henderson, 2017).
Malfeasance
It refers to performing an action that should have never been performed in the first place; using prohibited and flammable materials to reconstruct old buildings results in the structure being converted into a firetrap, causing a disaster (Stoyanova, 2020).
Under tort law, those held liable for causing injury to others are required to compensate the plaintiffs. Common harms include lost wages in the future, reimbursement of hospitalization costs, and compensation for pain and distress. Friedell (2020) explains that “extra punitive damages can also be awarded to compensate the victim instead of fair compensation.” Tort law is classified as follows: strict liability torts, intentional torts, and negligent torts. Negligent torts include damages caused to individuals due to another’s inability to practice a certain degree of care. Mishaps are a frequent occurrence of negligent torts!
Similarly, deliberate torts are harms caused to people deliberately by another person’s misconduct, such as abuse, deception, and robbery (Morgan, 2021). In contrast to negligence and malicious torts, strict liability torts are not associated with the collaboration of the individual who causes the damages. Rather than that, strict liability is directed at the action itself. If anyone or any agency performs an act for example, manufacturing a faulty product the individual or entity is liable for the resulting damages, regardless of the degree of care practiced or their motives (Friedell, 2020).
