I have an case study commerce assignment on the Commonwealth vs ACT (2013) (australia), and there are mutliple different parts to write about including:

1. IDENTIFY the type of legal case you have chosen.
2. DESCRIBE the court where this legal case was heard and tried in (INCLUDE a diagram of the Australian court hierarchy). Describe the main functions of this type of court.
3. EXPLAIN the type of offence the individual/group is accused of (CRIMINAL) or the type of dispute (CIVIL).
4. IDENTIFY the legislation in Australia that is associated with this offence.
5. EXPLAIN the decision made by the court. Discuss your support and/or disagreement with this decision; use previous legal cases to support your reasons for this.
6. EVALUATE the impact of the case on three stakeholders (eg: the victim, the accused, the community)
7. DESCRIBE the variety of evidence used in the court case and explain which is the most significant piece of evidence in the trial.

High Court of Australia.

The role of the High Court of Australia is to interpret and enforce Australian law, to develop logical common laws that apply throughout Australia, and to supervise the decisions of lower courts.

Dispute between same-sex marriage

The Marriage Amendment (Definition and Religious Freedoms) Act 2017

High Court decides the ACT’s same-sex marriage law is invalid. Today, 12 December 2013, the High Court decided unanimously that the ACT’s Marriage Equality (Same Sex) Act 2013 cannot operate concurrently with the federal Marriage Act 1961. The Marriage Act states that a marriage can only take place between a man and women and that a marriage between a same sex couple must not be recognised as a marriage in Australia.
