In the process she spilled the whole cup on her lap. She was wearing sweatpants which absorbed and held the coffee against her skin, scalding her thighs, buttocks, and groin. She was taken to the hospital where she suffered third degree burns on 6% of her skin and lesser burns on 16% of her skin. She was hospitalized for eight days and had skin grafting due to the burns. She lost twenty pounds, suffered permanent disfigurement and was partially disabled for two years.Her medical expenses were $10,500, and she needed future medical procedures costing approximately $2500. She lost $5000 in income making her total financial damages $18,000.The corporate headquarters of the restaurant required the chain to keep coffee at 180 -190 degrees. At 190 degrees coffee might cause third-degree burns in two to seven seconds. And evidence showed many other restaurants, not in the chain, kept coffee at a must lower temperature – not hotter than 140 degrees, to prevent burning.
